Terms of Service - Custom Mammoth

1. Acceptance of These Terms

These Terms of Service (“Terms”) govern your access to and use of customammoth.com (the “Site”) and any purchase you make from Custom Mammoth (“we,” “us,” or “our”). By accessing the Site, creating an account, submitting any materials, or placing an order, you agree to be bound by these Terms and by our Privacy Policy, Shipping Policy, and Refund Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Site or place an order.

2. Who We Are

Custom Mammoth (also operating as Mammoth Engraving on Etsy) is a small online shop that produces custom laser-engraved products. We sell online only. You may contact us at customammoth@gmail.com.

3. Orders and Pricing

All orders are subject to acceptance by us. Placing an order is an offer to purchase and does not by itself create a binding contract until we accept it. We reserve the right, in our sole discretion and at any time, to refuse, limit, or cancel any order or quantity, including after an order has been placed or paid, for any reason, including suspected fraud, unavailability of materials, inaccurate or incomplete order information, or content we decline to produce. If we cancel an order after payment and before production, we will refund the amount paid for the cancelled order, which shall be your sole remedy.

Prices, product descriptions, and availability are subject to change without notice. Despite our efforts, the Site may contain typographical, pricing, or other errors. If a product is listed at an incorrect price or with incorrect information, we may cancel the order or contact you for instructions before proceeding, even if the order has been confirmed or paid. Prices do not include customs duties, taxes, or other fees unless expressly stated, and such charges are your responsibility.

4. Custom Orders and Design Proofs

All products are custom-made to order based on the information and materials you provide. Before any engraving begins, we send you a design proof by email and through the platform you ordered on. Production begins only after you approve the proof.

You are solely responsible for carefully reviewing the proof, including spelling, grammar, names, dates, numbers, punctuation, layout, sizing, placement, and overall design. Your approval of a proof is final and constitutes your acceptance of the design as shown. We are not responsible or liable for any errors, omissions, or design elements that appear on a proof you approved, or for errors contained in the information or files you submitted.

Please check your email, including spam folders, and reply to approve or request changes. If we do not hear back within 5 business days after we send the proof, and after we have tried to reach you, we may complete your order based on the details you provided and our best design judgment. Orders completed this way are final.

Proofs are digital representations only. Colors, contrast, scale, and appearance on screen may differ from the finished product. The quality of the finished engraving depends in part on the quality of the files you provide; low-resolution or blurry images may not engrave cleanly.

5. Natural Materials and Variations

Many of our products, including river rocks and slate, are made from natural materials. Each piece is unique and may vary in shape, size, color, texture, and surface, and may contain natural marks, pits, veins, or imperfections. Engraving depth, contrast, and appearance may vary from piece to piece, from product photos, and from the proof, depending on the material. Such variations are inherent to custom and natural materials, are not defects, and do not entitle you to a remake, replacement, or refund.

6. Production and Shipping

All production and delivery times are estimates only and are not guaranteed. Small orders can often ship the same day if the design proof is approved early; larger orders usually ship within 3-5 business days after approval, and during busy times any order may take up to 3-5 business days. Orders with Express shipping get rush processing automatically. For other shipping options, you may add Rush processing at checkout for $2.95 per order; Rush processing means we start on your order first, but it is not a promise of any specific ship or delivery date.

We are not liable for delays caused by carriers, customs, weather, or any other events outside our control, and we are not responsible for the availability, cost, or performance of the carrier you choose. Title and risk of loss pass to you upon our delivery of the package to the carrier. We are not responsible for loss, damage, theft, or non-delivery after the package has been transferred to the carrier, and any such claims must be directed to the carrier. 7. Returns and Refunds

Because all products are custom-made to order, we do not accept returns or issue refunds, except as expressly stated in our Refund Policy. In the rare case of a verified production error on our part, any remake is offered at our sole discretion and does not create a right to a remake, replacement, or refund. Please review the Refund Policy, which governs all such matters.

8. Customer Materials and Intellectual Property

Any logos, images, artwork, text, designs, or other materials you submit to us (“Customer Materials”) are used solely for the purpose of fulfilling your specific order.

By submitting Customer Materials, you represent, warrant, and agree that:

You own all rights, title, and interest in the Customer Materials, or you have obtained all necessary licenses, permissions, and clearances from the rightful owner(s).
The Customer Materials do not infringe, misappropriate, or violate any copyright, trademark, trade dress, patent, publicity right, privacy right, or any other intellectual property or proprietary right of any third party.
You have the full legal right and authority to authorize us to use the Customer Materials to produce and deliver your order.
You will indemnify, defend, and hold harmless Custom Mammoth (Mammoth Engraving), its owners, and affiliates from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to any claim that the Customer Materials infringe or violate any third-party rights.

We do not review Customer Materials for intellectual property compliance and make no representations or warranties regarding the legality of any designs you provide. We reserve the right to refuse any order that we, in our sole discretion, believe may infringe third-party rights, without liability to you.

We do not acquire any ownership rights in your Customer Materials. We will not use your designs in our marketing, portfolio, or examples without your prior written permission.

You agree that Custom Mammoth shall not be liable for any claims, damages, or losses arising from or related to the intellectual property status of any materials you provide. All risk associated with the rights to designs, logos, text, and artwork rests solely with you.

9. Our Content

All content on the Site, including photographs, product images, text, graphics, logos, original designs created by us, and the selection and arrangement of that content, is owned by or licensed to Custom Mammoth and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, modify, publish, or create derivative works from any Site content without our prior written permission. Designs, layouts, logos, or artwork that we create for your order (including custom designs made by our team) remain the property of Custom Mammoth (Mammoth Engraving). You receive the finished product and a non-exclusive license to use the design on that product for personal use. Full rights to the design are not transferred to you unless separately agreed in writing and paid for.

10. Prohibited Uses

You agree not to use the Site or our services to:

Submit or order content that is unlawful, infringing, defamatory, obscene, hateful, threatening, harassing, or otherwise objectionable, as determined by us in our sole discretion;
Violate any applicable law or the rights of any third party;
Provide false, misleading, or fraudulent information, or make fraudulent payments or chargebacks;
Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or related systems;
Use any robot, scraper, or automated means to access or copy the Site or its content;
Upload viruses, malware, or other harmful code.

We may refuse service, cancel orders, or restrict access to the Site for any violation of these Terms.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ALL CONTENT, AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT PRODUCTS WILL MEET YOUR EXPECTATIONS OR MATCH PRODUCT PHOTOS OR PROOFS EXACTLY. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CUSTOM MAMMOTH (MAMMOTH ENGRAVING), ITS OWNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO THE SITE, THESE TERMS, OR ANY PRODUCT OR SERVICE, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO ANY ORDER SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THAT ORDER. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Custom Mammoth (Mammoth Engraving), its owners, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to (a) your use of the Site or our products or services, (b) your Customer Materials or any information you provide, (c) your breach of these Terms, or (d) your violation of any law or the rights of any third party.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permissible or severed, and the remaining provisions shall continue in full force and effect.

16. Changes to These Terms

We may update these Terms at any time by posting the revised version on this page with a new “Last updated” date. Changes take effect when posted. Your continued use of the Site or placement of an order after changes are posted constitutes your acceptance of the revised Terms. The Terms in effect at the time you place an order apply to that order.
